Who is at Fault in a Parking Lot Accident?

Parking lot accidents are unfortunately quite common and often have serious consequences. Parking lot accidents may seem less ominous due to their typical low-speed impacts, but they still can result in severe injuries, damage, and sadly even death.

Determining who is at fault in a parking lot accident is more complex than other road-related accidents. If you are involved in a parking lot accident, it is important to speak with an attorney to help establish fault and determine insurance coverage.

When you factor in Florida’s no-fault state law, parking lot car accidents can become even more complicated. Should the damages exceed your PIP coverage, never assume the fault and financial responsibility is yours to carry.

Our injury lawyers at Mickey Keenan, explain five common types of parking lot accidents in Florida and how fault may be determined. Please don’t hesitate to contact us to speak about the specifics of your case at 813- 871-1300.

5 Common Types Of Parking Lot Accidents

Before we start, remember: if you or your family has been hurt in a seemingly small car accident, make sure to seek medical attention within 14 days to make sure your injuries are noted and any healing can begin.

Here are the common types of accidents clients have been involved in:

Two drivers backing out at the same time

In this scenario, two drivers back out of separate parking spaces simultaneously and hit each other. Both drivers in this situation are responsible for looking while they back out, so both drivers will share fault unless there is clear evidence of negligence on the part of one driver.

Two drivers attempt to pull into the same parking space

If two drivers try pulling into the same parking space at the same time and collide, the driver at fault would be the one that did not have the right of way. The driver that does have the right of way into the spot is not at fault unless again there is clear evidence of negligence on the part of the right of way driver.

A driver pulls out into oncoming traffic

Oftentimes a driver may pull out of a parking space right into oncoming traffic. The driver that was in the lane of traffic has the right of way, making the driver that pulled out into traffic at fault.

A driver backs out into oncoming traffic

Similar to the above scenario, a driver is backing out into oncoming traffic. The driver backing out is liable and at fault since the oncoming traffic has the right of way.

A driver hits another driver at a stop sign

In this final parking lot accident scenario, two cars hit at a stop sign. In this scenario, the at-fault driver would be the driver that hits the other car from behind.

Another stop sign scenario involves two drivers hitting at a 2-way stop or 4-way stop. In this scenario, the at-fault driver would be the one that did not have the right of way.
